Commerce can now block polysilicon entries, two months before the December 4 duties
A BIS temporary final rule (91 FR 60505), in force September 22 through December 3, lets Commerce bar an importer of record from consumption entries of polysilicon and its derivatives if its volumes since August 6 run substantially above its 2025 and early-2026 weekly averages. Importers of record registered on or after August 6 face hard weekly caps. CBP CSMS #69994928 says CBP will enforce the bar once Commerce names an importer, and brokers who file consumption entries for a barred importer are exposed under 19 U.S.C. 1641. Proclamation 11052 duties, 15 percent plus minimum import prices, begin December 4.
